Risk
Due to the somewhat strenuous nature of cycling/triathlon over varied terrain and distances, all members will be required to declare that they are in good health and are adequately and appropriately prepared both physically and mentally for training. If a rider has any health issues or doubts prior to the Training, he/she should immediately seek appropriate medical advice, and cease training until otherwise advised.
You understand and agree that participation in coaching is entirely at your own risk. You agree that you are participating in the training and riding on the express condition that RST Sport Ltd, nor its agent or representatives:
(a) will, under no circumstances be liable or responsible in any manner whatsoever for any death, loss, accident, damage or injury to you or any of your servants, agents, contractors, visitors or invitees or any other person whatsoever (“Related Party”) which may happen as a result of your participation in the Training Plan; and
(b) will not incur or be under any liability whatsoever to you or to any Related Party for any loss, damage or injury to or in respect of any of your property or of any Related Party’s property, except as occasioned by the grossly negligent acts or omissions of the Indemnified Person or its servants, agents, contractors, visitors or invitees.
You are aware of the physically strenuous nature involved in cycling over variable terrain and for long distances on public roads and the risks both mentally and physically.
You confirm you are healthy and fit enough (mentally and physically) to participate in this Training and Riding. You agree that should any medical or physical condition arise prior to the event which is likely to affect your ability to participate, you will withdraw from Training and Coaching until you are healthy enough to take part.
RST Sport Ltd strongly recommends that all participants engage in some training and preparation prior to using the Training Plan, especially if you have not exercised before or for some time. While we have training to suit varying levels of cycling ability, if you have not exercised before or for some time, you should consult your doctor before commencing your training. As a general guide, Training Plans are suitable for the athlete level suggested, however, you will need to ensure you have been training regularly prior to using even the Beginners level Training Plans.
You will be expected to have sufficient experience and skills necessary to ride with others in groups in typical side by side and in single file formation, akin to training rides typically undertaken by cycling clubs in most towns and cities.
Personal Property, Injury, Illness and Death Subject to the final paragraph of this section, we will not compensate you for any loss or damage you may suffer where the same is attributable to:
(i) Your own fault
(ii) A third party unconnected with our provision of services under this agreement; or
(iii) Events which neither we nor our suppliers could have reasonably foreseen or forestalled even if we had taken all reasonable care. Nothing in these terms and conditions is intended to limit or exclude our liability for death or personal injury caused by our negligence of for fraud, fraudulent misrepresentation or any other liability which cannot be excluded by law.
Intellectual Property We are the owner or the licensee of all intellectual property rights in our website, and the material published on it. All Training Plans, Coaching, and associated information are the Intellectual Property of RST Sport Ltd. It is expressly forbidden to re-use, disseminate, or similar our Intellectual Property without the express written permission of RST Sport Ltd.
